Golf Jobs Limited Terms of Service

These Terms of Service ("Terms") govern your use of the Golf Jobs Limited website and services (collectively, the "Platform" or "Service"). By accessing or using the Platform, you agree to be bound by these Terms and our separate Privacy Policy. If you do not agree with any part of these Terms, please do not use the Platform.
1. Definitions
"Golf Jobs Limited", "we", "us" or "our" refers to the company registered at Red Tree Magenta, Glasgow Road, Rutherglen, Glasgow, United Kingdom, G73 1SA (Company No. SC629106).
"User", "you" or "your" means any person accessing or using the Platform.
"Candidate" refers to any user who creates a candidate profile to browse or apply for jobs directly on the Platform.
"Employer" refers to any user or organisation that registers an account to post job vacancies or access candidate profiles.
"User Content" includes any content submitted by Users (including job postings, candidate profiles, resumes, cover letters, comments, and other materials).
"Aggregated Vacancies" means job vacancies collected from third-party websites for which Golf Jobs Limited has no control over the application process.
2. Acceptance of Terms
By using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. Your continued use of the Platform constitutes your acceptance of any modifications, updates, or revisions to these Terms.
3. Changes to the Terms
Golf Jobs Limited reserves the right to update or modify these Terms at any time. Changes will be effective immediately upon posting on the Platform. Your continued use of the Platform following any updates constitutes your acceptance of the revised Terms. We recommend reviewing these Terms periodically.
4. Account Registration
Registration Requirements:
To fully access the Platform and its features, you may need to create an account. During registration, you agree to provide accurate, complete, and current information.
Account Security:
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Please notify us immediately of any unauthorised access or other security breaches.
5. Description of the Service
Golf Jobs Limited operates a job board and careers service specifically for the golf industry. The Platform offers:
Direct Job Postings:
Employers may post job vacancies by registering an account and selecting a posting method (either via subscription or one-off posts). Employers are responsible for ensuring that all job listings are accurate, lawful, and comply with applicable regulations.
Aggregated Vacancies:
The Platform aggregates job vacancies from other careers websites and job boards for your convenience. Please note that applications for these vacancies are managed by third parties, and Golf Jobs Limited does not control or guarantee the accuracy of these listings.
Candidate Profiles:
Candidates can create profiles to browse and apply for jobs free of charge. When applying directly through Golf Jobs Limited, candidates must provide accurate and truthful information.
Enhanced Candidate Services:
In addition to the free services available, candidates may have the option to pay for enhanced access to priority jobs, special events, and other premium features. Specific details regarding fees, benefits, subscription terms, and cancellation policies for these enhanced services will be provided at the point of purchase. All fees for these services are non-refundable unless explicitly stated otherwise.
6. Job Listings and Applications
Job Listings (Employers):
As an Employer, you are solely responsible for the content of any job listings you post. You agree that such listings will be accurate, not misleading, and will comply with all applicable laws and regulations. Golf Jobs Limited does not guarantee the success of any job posting.
Job Applications (Candidates):
Candidates agree to provide truthful and accurate information in any application materials submitted through the Platform. Golf Jobs Limited is not responsible for hiring decisions made by Employers, nor does it guarantee the authenticity or accuracy of any job listing.
7. User Content and Intellectual Property
Standard Non-Exclusive License:
By submitting any User Content to Golf Jobs Limited, you retain ownership of your content. However, you grant Golf Jobs Limited a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your content for purposes related to the operation, promotion, and improvement of the Platform.
Trademarks and Service Marks:
All trademarks, logos, and service marks displayed on the Platform are the property of Golf Jobs Limited or third parties. You are not granted any right to use these without prior written consent.
8. Prohibited Activities and User Conduct
You agree not to use the Platform for any unlawful or harmful purposes. Prohibited activities include, but are not limited to:
Posting false, misleading, or fraudulent information.
Harassing, intimidating, or threatening other Users or Golf Jobs Limited personnel.
Attempting to gain unauthorised access to the Platform or other Users’ accounts.
Using automated means (such as bots, spiders, or scrapers) to access the Platform or collect User Content.
Violating any applicable laws, regulations, or third-party rights.
Failure to comply with these guidelines may result in immediate suspension or termination of your account.
9. Payment and Subscription Terms
Employer Subscriptions:
Employers must register for an account to post job vacancies and access candidate profiles. Subscriptions may be cancelled at any time; however, no refunds will be provided for any payments already processed.
One-Off Job Postings:
No refunds will be issued for one-off job vacancy posts, regardless of the outcome or whether the position is filled via the Platform.
Candidate Enhanced Services:
Fees for any enhanced services offered to Candidates (such as priority access to jobs and special events) are non-refundable unless explicitly stated otherwise.
10. Data Protection and Privacy
Golf Jobs Limited is committed to protecting your personal data in accordance with the Data Protection Act 2018 and the General Data Protection Regulation (GDPR). Please refer to our separate Privacy Policy for detailed information on:
The personal data we collect (e.g., candidate profiles, employer profiles—including name, email address, location, company, and website—and data from job alerts and mailing lists).
How we process and store your data.
The legal bases for processing your data.
Your rights under data protection law.
Data retention and the fact that personal data is not transferred outside the UK (although Employers outside the UK may access candidate profiles upon payment).
11. Modifications to the Platform
Golf Jobs Limited reserves the right to modify, suspend, or discontinue any aspect of the Platform at any time without prior notice. We may also impose limits on certain features or restrict access to parts or all of the Platform without incurring any liability.
12. Indemnification
You agree to indemnify and hold harmless Golf Jobs Limited, its affiliates, officers, directors, employees, agents, and representatives from any claims, damages, liabilities, losses, and expenses (including legal fees) arising out of or related to:
Your use of the Platform,
Your User Content,
Any violation of these Terms, or
Any breach of applicable laws or regulations.
13. Limitation of Liability and Disclaimers
Limitation of Liability:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GOLF JOBS LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. This includes, but is not limited to, damages resulting from errors, omissions, interruptions, defects, delays, or failures of performance.
Disclaimers:
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. Golf Jobs Limited does not guarantee that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components. All information, including job listings and aggregated vacancies, is provided for general information purposes only, and Golf Jobs Limited does not warrant its accuracy, reliability, or completeness.
14. Termination and Suspension
Termination:
Golf Jobs Limited reserves the right to terminate or suspend your account and access to the Platform immediately, without notice, if you breach these Terms or if your actions are deemed harmful or detrimental to the Platform or other users.
Effect of Termination:
Upon termination, your right to use the Platform will immediately cease. Provisions that by their nature should survive termination (including Sections 7, 9, 10, 12, 13, and 15) shall continue to apply.
15. Dispute Resolution
In the event of any dispute arising out of or in connection with these Terms or your use of the Platform, the following process shall apply:
Negotiation/Mediation:
The parties agree to first attempt to resolve any dispute through direct negotiations. Should such negotiations fail to resolve the dispute promptly, the parties will proceed to mediation with an independent mediator. The selection and cost of the mediator shall be mutually agreed upon.
Litigation:
If mediation does not resolve the dispute within a reasonable time, either party may seek resolution through litigation. Any legal proceedings arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
16. Governing Law and Jurisdiction
These Terms and any disputes arising out of or related to the Platform shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles. All disputes shall be submitted to the exclusive jurisdiction of the courts in England and Wales.
